Banks Say No to Marijuana Money, Legal or Not

New York Times:  “Legal marijuana . . . businesses are conducted almost entirely in cash because it is exceedingly difficult for them to open and maintain bank accounts, and thus accept credit cards.  The . . . drug remains illegal under federal law. The Controlled Substances Act, enacted in 1970 classifies marijuana as a Schedule I drug, the most dangerous category, which also includes heroin, LSD and ecstasy.  As a result, banks, including state-chartered ones, are reluctant to provide traditional services to marijuana businesses. They fear that federal regulators and law enforcement authorities might punish them, with measures like large fines, for violating prohibitions on money-laundering, among other federal laws and regulations.  “Banking is the most urgent issue facing the legal cannabis industry today,” said Aaron Smith, executive director of the National Cannabis Industry Association in Washington, D.C.”

USA Today:  “The legal sales have spurred heavy demand, and some smaller stores have reported either rationing sales or running out entirely. Prices have changed accordingly: . . . the retail price of pot leaped from about $2,500 a pound to $6,000 a pound within days of Jan. 1.  State and local taxes add up to about 20%-25% of the purchase price, depending on location, and vendors are allowed to charge whatever the market will bear. Customers from across the country have flocked to the Denver area, where most of the stores are located. Some smaller communities have banned sales, while others are developing their permitting processes.”

Time:  “A few days into the experiment, the new world of legal recreational marijuana sales in Colorado appears to be a big success—so much so that pot shops are finding it impossible to keep up with demand.  According to the Denver Post, at least 37 stores in Colorado were licensed to sell recreational pot to anyone 21 or over as of New Year’s Day. The Associated Press and others reported long lines outside Denver pot shops, with some eager customers forced to wait three to five hours before getting a chance to go inside, step up to the counter, and make a purchase.”

Pot Business Banking Issue is on Agenda as Bank Group Meets

Seattle Times:  “For the nascent marijuana industry in Colorado and Washington there is a lot riding on a meeting Thursday in Washington, D.C., of an obscure financial-watchdog group. . . . the next big challenge: getting banking services to pot merchants so they won’t have to conduct all their business in cash.  Sen. Patrick Leahy, D-Vt., chair of the Senate Judiciary Committee, implored the Treasury and Justice departments to work together to solve the problem. Now, because pot remains federally illegal, banks are loathe to provide checking accounts and loans to pot merchants for fear of being prosecuted for money laundering.  On Thursday, the federal Bank Secrecy Act Advisory Group (BSAAG) will hold its first meeting since the DOJ’s watershed announcement in late August. The meeting is a chance for industry, regulators and law enforcement to have a “frank discussion,” according to a Treasury Department spokesman.”

Feds Raid Denver-area Marijuana Dispensaries, Grow Operations & 2 Homes

Denver Post:  “Six weeks before the nation’s first retail marijuana shops open in Colorado, federal authorities on Thursday raided more than a dozen Denver metro area marijuana facilities and two homes.  In the largest federal raid on Colorado marijuana businesses since medical marijuana became legal, federal law enforcement agents with an assist from local police officers executed search and seizure warrants at multiple dispensaries and cultivation facilities — at least a dozen in Denver alone.”

Doctor Says Arizona Republic Dead Wrong on Arizona’s Medical Marijuana Program

Arizona Republic:  “doctors won’t write you a ‘recommendation.’ It’s scary as a physician. I wouldn’t do it. Risk my license? Be reported to the Arizona Department of Health Services? Scrutinized? Exposed? Definitely not worth losing my job! So these same doctors print out patient records and hand them to their patients. ‘Go to a recommendation center. I can’t do it.’  Will Humble, director of the ADHS, is disingenuous when he says he wants the primary-care physicians to write medical-marijuana recommendations. That will not happen as long as the physician receives federal reimbursement for services (e.g. Medicare) and fears this will be taken away. That will not happen until physicians can speak freely without fear of reprisal. Mr. Humble is a smart guy. He knows this. . . . Did you know that cannabis concentrates are currently illegal under the Arizona criminal code? I would guess from The Republic’s uninformed editorial that editorial-board members do not.  Please, Republic editorial board, do readers a favor and use your platform responsibly. The editorial was sloppy journalism even as an opinion piece. . . . The readers of The Arizona Republic deserve better.
